RIVER BEND HOMEOWNERS ASSOCIATION MONTHLY MEETING JANUARY 2, 2013
LIMESTONE LIBRARY 6:30PM
Board members present: Erin Walker, Debbie Turner, Andrea Cinnamon, Steve Devine
1 homeowner present and John Bevis from the Health Department
Called to order at 6:30pm by Erin with a motion by Debbie and seconded by Andrea and all others agreed
John Bevis here to tell us about septic options in our subdivision the house in question is waiting for the board decision to allow discharge in to the retention pond and then they will issue and approve the application and permit the Health Dept was informed this week by Steve after a board vote last month that the entire septic system had to be on their property but we understand with the slope of the ground on their property there will be some run off of clean water in to the retention pond as there also is from two other homes around the pond which was previously approved before a board was formed (by Azzarelli Developement)
Option 1- common drainage tile which could have three houses attached and would drain in a tile to the drain in the retention pond and then on to river The HOA would have to pay for this and the cost is not known at this time Per the Health dept this was originally in the subdivision plans to be done by Azzarelli but was not done and there is no record at the health dept as to why
Option 2- tank and drainage fields is what is already there and has failed so this is not an option for the homeowner
Option 3- Aeration system with direct discharge on their property and then going to the retention pond due to the slope of the land There could be a pipe or a rock receiving area whcih would also be on their property There are already 2 others around the pond with this type of system one is 10 feet from the property line which is now code and the other received a variance and was allowed to drain directly in to the retention pond (This was again done before a HOA was formed ) Aeration systems treat themselves and discharge clean water they must be inspected and pumped every 6 months by the homeowner This is the plan that will be recommended to the homeowner by John Bevis Mr Bevis said there are pamplets available at the Health Dept to educate homeowners on their systems as he stated many people never get their systems pumped or checked and this should be done every 2-3 years we will get some information for the annual meeting
Secretaries report read by Debbie with motion to approve by Steve and seconded by Andrea All others agreed
Treasurers report read by Debbie with motion to approve by Steve and seconded by Erin and all others agreed
Debbie will check if the dog run that a letter was sent out about is still there Debbie will get the taxes done after the December bank statement is received

RBWCA 6-6-12

Original meeting of June 6, 2012 rescheduled to June 13 as we would not have a quorum.
Only board members present at June 13 meeting were Erin Walker, Debbie Turner and Steve Devine. No homeowners present. We were in the main part of the library as there was no room available. There was not a quorum so meeting could not officially be held.
Debbie did receive the tax bill which is due June 20, 2012.Steve made a motion to pay and Erin seconded. Debbie will call other board members to get their vote. Rod Middleton also called Debbie and asked for partial payment for the work in the retention pond. Steve motioned to pay half and Erin seconded. Debbie will also call to get the others votes and then pay this.
Steve has been calling the health dept weekly about the issue with the septic and the retention pond which is holding up the finish of the work of removing the cattails. He has not gotten any answers so far. He talked with Mike Bossert, a homeowner who is on the County Board, who said he will get this going for us. It could be 30 days for them to check on it and then the homeowner has 30 days to come up with a plan to fix it. Debbie will let Rod know this and see if he can do most of the other work so this can be finished.
The next meeting is scheduled for July 4 which is a holiday so Erin checked to see when the room is next available which is Wed July 18 at 6:30pm
Addendum: Leroy Sarowatz, Andrea Cinnamon and Dave Baron all agreed to pay the taxes and to pay Rod Middleton half of his balance due and the rest when the job is finished.
When Debbie brought the check to Rod on June 14, 2012, he questioned the dollar amount. He said his bid was for $8500 not $3400 as we read it. Debbie will get in touch with the other board members to address this.
Leroy also asked that I make up a list of homeowners who have not given us their emails so we can let them know by letter that this will be our form of communication. Debbie will make this list and bring it to the next meeting for discussion.
July 17, 2012 Third time talking with Rod and he agreed to match next low bid of $4500 and $150 to remove the pile of debris from fox Run lot. This will be voted on at the July meeting.

Leroy also asked that he clean up the other retention pond of the pile of debris that has been dumped there for an additional $150. This was seconded by Dave. Steve said the homeowners by the retention pond that had septic backing up into the area has a contractor to do the work. Debbie will let Rod know. Dave will talk to Chad Gessner about the cars that speed through the neighborhood to see if there is something that can be done. Debbie will send a letter to the 22 homeowners who have not given us their email to let them know that will be our main mode of communication or the website. Debbie will get copies of the covenants to the 2 new homeowners in the subdivision. Debbie will also add the website address to the next email that goes out to the homeowners. Leroy gave Debbie a list of covenant violations that letters need to be sent out for. The next meeting will be back on schedule Wed August 1. Diana was here to answer homeowners questions about the water and construction etc They plan on working through the winter and to be in our subdivision in the spring They will lay the pipes out for one days use or put them in Azzarelli empty lots in the other part Shell says that any well before 2008 will be capped Any well after that it is up to the homeowner but our covenants say everyone has to hook up within one year so if someone chose not to have Shell do it now for free they would have to pay with in a year to have it done We will clarify this with our attorney The pipeline will be at the top of the ditch about 5 feet in from the road When fixing driveways they will go to the next seam We should take pictures of landscaping etc to be assured it is fixed correctly they will issue check to us to have repairs done though they will fix the standing water problem already on Pipeline Road The dirt taken out will be put back We should mark our sprinklers to prevent damage to them she had the maps here as to where the pipes are going If there was sod it will be replaced with sod or whatever grass seed we want Diana stated that Kankakee County is trying to pass an ordinance to seal all wells in the core area they still plan on boring under the roads to put the pipes in
It was asked if the River Bend signs that were painted a few years ago were sealed- Debbie will check on the old paperwork
It was asked about the pile of debris in the retention pond- the homeowner who lives by it is going to clean it up We will check when the work will be done on the septic so that Rod Middleton can seed the other retention pond We were told that there is a septic draining into the retention pond with the pile of debris also and Leroy will check into this

Treasurers report was read by Debbie with motion to approve by Steve and seconded by Andrea
Miscellaneous: We will not have a wiener roast this fall Debbie talked to the attorney and per our covenants all houses in the subdivision must hook up to Aqua water within one year even if they did not sign the shell papers Shell will still hook them up for free at this time (except one home) but if they decline they will have to pay to have it done within the next year It will be up to the board to enforce this Erin will email Diana to be sure she understands so she can talk to homeowners as this comes up also and also ask who has not signed the agreement Nothing needs to be done with the lien we have and she said it would be too costly to put a lien on a house for nonpayment of dues that is in foreclosure The River Bend signs are not sealed and we will not do anything with them at this time as they are in good shape The for sale signs on Stone Ridge Dr are gone and the overgrown property is getting cleaned up Steve will follow up with the health department on the septic system on Valley View and inquire about a possible second problem on the other side If we do not get an answer as to when this will be fixed we will get in tough with IDPH as it has been over 6 months already
Leroy is going to be spending the winters in Florida so he is stepping down from the board effective immediately We will discuss a replacement at the next meeting to fill in until the February election
Motion at 7:10 pm by Debbie to adjourn and seconded by Andrea

RBWCA 11-7-12

The meeting was called to order at 6:30 pm by Erin Walker with a motion by Dave Baron and seconded by Steve Devine. All others agreed. The treasurers report was read by Debbie Turner. A motion was made by Dave and seconded by Steve to approve, all others agreed. The secretaries report was read by Debbie and approved with a motion by Dave and seconded by Steve. All others agreed. Board members Andrea Cinnamon and Chris Benoit were also present.
Steve called the health department about the two septic tanks on 10-4 and 11-7 and talked to a man named Brian. The homeowner on the first one has the permit and is waiting for the contractor and the health department to start. The health department put dye in Scanlons water today and will check it tomorrow to see if that is where the water is coming from in the other retention pond. Steve will follow up on this.
A motion by Dave and seconded by Andrea was made to allow Shell Pipeline to stack the pipes for the River Bend water project on the river front property where they are already working.
Dave made a motion and Erin seconded for a letter to go out to all the homeowners about the status of the well capping and the entire project. Debbie will check with Diana that the letter is ok and ask about a few other houses to see if they were included in the settlement. She will also check to see about the marking on the road by the 113 sign.
Debbie will also check with Rod to see if dirt will be brought in for the retention pond before it is seeded or if he will just have to regrade it.
We will have to make a decision on the Shell money before taxes are done this year. We feel our main focus will be on the river front: trees, split rail fence, landscaping and clear area to the river for small boats. We would also like to re landscape the signs that were messed up with construction, upgrade lights and plant more bushes etc.
Dave made a motion at 7:05 to adjourn and Steve seconded.

RBWCA 12-5-12

Called to order by Erin Walker with a motion by Debbie Turner and seconded by Chris Benoit. All others agreed. Secretaries report read by Debbie with motion by Chris to approve and seconded by Andrea Cinnamon. All others agreed. Treasurers report read by Debbie with a motion to approve by Leroy Sarowatz and seconded by Steve Devine. All others agreed. Dave Baron not able to attend. Three homeowners present. (Leroy did say he would step down at the October meeting because he was moving to Florida part time but then let us know he would be available for the December meeting so he will stay on until the annual meeting when we can elect a new board member).
Old Business: Leroy thanked the Johnstons for cleaning up their yard. The dye put in to check Scanlons septic came up negative. He did state that sometimes he drains his hot tub which could be what was seen. The health department stated they are waiting on us to make a decision about the other septic???? They want permission to put the discharge for the aeration system in the retention area. The homeowners association will not allow this as all of a homeowners septic system must be on their own property. Steve will notify the health department. He will also see if the health department could come to a meeting to answer some questions. Mike Bossert also informed us that Shell is having trouble boring under the road at the 113 sign and are working with IDOT to possibly cut the road. Leroy made a motion to pay $10 to the state for the incorporation fee and Erin seconded. All others agreed.
Public comment: One couple had questions about the city water. This was all questions already answered at other meetings so they were given answers and Diana Lundgrens card. Mike Bossert stated that there was an error in the letter that went out to homeowners about the Aqua water and Shell settlement. It stated that the county would ensure the wells were capped after water was brought in and he said the county will have nothing to do with this. If a homeowner gives Shell a problem with capping their well after they have signed the agreement, it would have to be taken care of in court. Thank you for the clarification.
Meeting was adjourned at 7:05 pm with a motion by Debbie and seconded by Steve and all others agreed.

RIVER BEND WEST COMMUNITY HOMEOWNERS ASSOCIATION MONTHLY BOARD MEETING WEDNESDAY DECEMBER 7, 2011 LIMESTONE LIBRARY
Meeting called to order at 6:30pm by Erin Walker. Board members present: Erin Walker, Debbie Turner, Jim Gall, Chris Benoit, Dave Baron and Leroy Sarowatz. We are now short one board member after the sudden death of Jeff Duffield last month. One homeowner, Linda Faber, was present and volunteered to be on the board to fill the vacancy until the election.
Secretaries report was read by Debbie, motion to approve by Dave , seconded by Leroy and all others agreed.
Treasurers report was read by Debbie, motion to approve by Dave, seconded by Leroy and all others agreed. Two new bills were presented: $10 to Secretary of State for the association annual report and $58.13 to Erin Walker for the flowers she ordered for Jeff’s services. Dave made a motion to pay these bills and Leroy seconded and all others agreed.
Old Business: Erin will call the attorney again as we have not heard back from her on the status of the lawsuits for non dues payment and the boat or her opinion on the new attached garage.
New Business: Leroy suggested we order three banners for the annual garage sale to post at the entrances. Debbie asked if she could get better signs made for the meeting notices as the old ones are in bad shape. Debbie will call again about the mowing bill and Erin will ask the attorney about her bill before the end of the year. Debbie will get the taxes done after Jan 1. We will have a sign up sheet at the annual meeting asking for email addresses so we can do an email vote on future issues since very few people come to the meetings to vote. We will talk about the shell money and what to do with it at the annual meeting. Dave asked for a new listing of all homeowners, Debbie will provide this to the board members. The annual meeting will be Feb 4, 2011 at the library at 10 am. Debbie will check with the library that the room is available. A nominating committee was named: Shan Cinnamon, Chad Gessner and Christy Strole. Debbie will call and ask them to get homeowners to replace Jim Gall and Jeff Duffield. Erin will let us know if she wants to run again. Chris will stay on as long as his work schedule does not change. Through word of mouth we heard that Steve Devine and Rich Berns may be interested as is Linda Faber if needed.

The meeting was adjourned at 7pm with a motion by Dave and seconded by Chris and all others agreed.

RIVER BEND HOMEOWNERS ASSOCIATION BOARD MEETING MAY 4, 2011
LIMESTONE LIBRARY 6:30pm
Called to order by Erin Walker Board. Present: Erin Walker, Jeff Duffield, Debbie Turner,
Chris Benoit, Jim Gall, Dave Baron & 4 homeowners present
Secretaries report was read by Debbie. Motion to approve by Jeff, seconded by Dave and all others agreed. Covenants were sent to the 2 new homeowners.
Email working well: Debbie sent notices about egg hunt clean up and meeting.
Treasurer's report read by Debbie. Motion to approve by Chris seconded by Jeff, and all others agreed.
Motion by Dave, seconded by Jeff to pay the liability insurance to Datweiler Insurance, which is due May 18 all others agreed. Second notices were sent to 5 homeowners for dues all but 4 have now paid.
Mowing bids were opened and reviewed. Lowest bid was Jeff Duffield. He will start mowing tomorrow.
12 kids were at the Easter egg hunt in the rain. Four homeowners were at the clean up. We planted at the 113 sign, cleaned up the River Bend sign and picked up garbage. We would have to call the county to do a controlled burn by 113 so that may be left to the homeowner.
Shell representative was here to answer questions. They will start digging at 4000 Rd in June and reach us by Fall but probably won’t start here until Spring 2012. Our wells will be capped- cut 2 ft down pull out pump and fill with solution to seal. Fire hydrants about 300 ft apart will be installed. They will dig down 4 ½ feet at stick and by house for pipes will fix landscapes and driveways. Well, they'll probably give homeowner a check to fix it themselves after we get bids. Pipes will be 5 ft off road in ditch.
One homeowner present was upset again about pool issue. No pools are allowed.

Meeting called to order by Linda at 6:35pm. No public comment. Debbie read secretaries report, motion to approve by Erin, seconded by Dave and all other in agreement.

Old Business: Christy will post minutes and financials to website but needs three month leeway. She will note that on the site also. It will also be put on the website that if a homeowner wants to discuss something with a board member other than in a meeting, to be courteous and call first. It will be encouraged to bring the matter if not urgent to the next scheduled meeting.

Most covenant issues were resolved„ others to be discussed in closed session.

The pile of brush by 113 will be burned by property owner. There was some discussion about the water project; a rep is going to each house to get papers signed.

Allied Waste lowered prices again to match the city of Kankakee. $14.26 and $1.30 admin fee per month. No fuel charge.

New Business: There are no pressing issues so there will be no Dec meeting. Ô will send
insurance cover sheets to Ô Lemenager Ô Insurance and Mike Ô for quotes. Mike Ô come to a meeting to talk to us also. We currently use Ryan Ô who will also give a new quote.

10-5-10

RIVER BEND WEST COMMUNITY HOMEOWNERS ASSOCIATION MONTHLY BOARD
MEETING OCTOBER 5, 2010 LIMESTONE TOWNSHIP LIBRARY
Board members present: Erin Walker, Debbie Turner, Jim Gall, Steve Ô
Goytia, D. Rivard
1 homeowner present with his son

Erin called the meeting to order at 6:40pm with a motion by Dave, seconded by Debbie. Debbie read the secretaries report. Dave made a motion to accept, Steve seconded and all were in agreement.
Dave read the treasurers report. Debbie made a motion to accept, Steve seconded
and all others agreed.

Mr Don Anderson was present and had public comment. He again brought up the subject that his pool was not a swimming pool as deemed not allowed in the covenants but rather just a pool which is allowed. He again brought up about outhouses and hot tubs which he says are not allowed but are present. He was told that no pools are allowed as per
the covenants and the covenants do not address hot tubs or outhouses. He still feels we can not waive the dues of new board members. He states we never have a quorum when we vote. He left after about fifteen minutes of complaints.

Old business: the lights were installed at Denaults corner on the sign. Lot 40 was cleaned up.
Lot 54 is working on it. Lot 34 will get it cleaned up but was upset because this is the neighbors dumping on her empty lot. She asked that letter be sent to her neighbors to not dump there. Debbie will do this. The street at Devines corner has been fixed. Debbie will call Kramer about the holes from the water company.

The bonfire went great about 50 people present.

See attached proposal from Allied Waste for garbage service. A and J said they could match the service but would need to keep their price now which is about $8 more per month. Debbie will distribute a flier to let homeowners know their options and make their own decision.

The park district will add more mulch at the park but will probably wait until the spring. All minutes and covenants are now on the website. Dave will also send Christie the financials to post.

Erin called the county about sheds and their only rules are that they can be no closer than 5 feet to the rear of the property, no more than 22 feet high, must have a permanent foundation and there is no limit on size.

Compliance committee update was given by Steve. He heard back from the attorney on some of the points that were asked. The committee will meet again soon. Steve will email each of us the updated covenants the attorney did and ask her to finish the questions she did not answer. Steve statedthat we could put a lien on property for fines that were imposed for not following the covenants. See the enclosed attachment.
Dave made a motion to go into closed session to discuss some issues, Jim seconded.
Meeting was adjourned at 7:20 with a motion by Steve and seconded by Debbie

RIVERBEND WEST COMMUNITY HOMEOWNERS ASSOCIATION BOARD MEETING SEP 7, 2010 6:30 PM LIMESTONE LIBRARY BOARD MEMBERS PRESENT: LINDA FABER, ERIN WALKER, DEBBIE TURNER, DAVE RIVARD, JIM GALL 3 HOMEOWNERS PRESENT
Called to order by Linda at 6:30 pm. Public comment by Jim Bruno asking for a copy of the covenants because he believes a neighbor has a steel shed that is not in compliance. Linda told him that since the shed has been there since before the board was active and the current owners bought it, we felt that there was nothing we could do as told to us previously by the county. He asked that we check with our attorney which we will do and Erin will also call the county to see if anything has changed on our rights to enforce this. He also asked about the potholes by Devine’s corner. Linda did call the road commissioner and was told it would be fixed three weeks ago. Debbie will send a letter to him and the township board. Debbie will get Jim a copy of the current covenants. The secretary’s report was read by Debbie, motion to approve by Erin and seconded by Dave- all others were in agreement. Treasurer’s report was read by Dave, motion to approve by Erin, seconded by Debbie- all others were in agreement. There is only one homeowner who has not paid their dues now. Dave asked to be paid for postage for $8.00. Debbie made the motion, Erin seconded and all others agreed. OLD BUSINESS: Debbie will email all minutes to Christy to put on the website as well as the covenants. Linda talked to Denaults about putting lights on the sign by their house and they were happy to have them. Debbie volunteered to purchase these for $60. A motion was made by Debbie and seconded by Dave and all others agreed. Debbie will call Scenic landscaping to see if they are done with the landscaping on the corner lot and also to see if they are being paid for the lots they mow for homeowners who have not built yet. (2) The insurance bill questions from last month did not need a call around vote because one bill was for the property liability and the other was for the board members liability which had already been approved to pay as these are billed in two parts. The new board will get quotes next year to seek a better price. The “NO CONSTRUCTION TRAFFIC” sign by 113 is down again- Donnie Turner will check this again as it was up when he last checked. Chris was not here to tell us if the park had more mulch added so Debbie will check on this. NEW BUSINESS: Weenie Roast will be Sunday Oct 3 at 5pm since Saturdays are so busy. We want more people to be able to come. Linda will get s’mores and condiments, Debbie wood and Erin hot dogs, buns and plates. Debbie will do the flier. The covenants committee met at Steve Goytias. Present was Debbie Turner, Steve Schultz, Rita Sproul, Dave Baron, and Steve Goytia. They compared 3 different subdivisions covenants and prepared a list of possible clarifications to give to the attorney to review. Again these were only some minor wording changes. They will meet again after hearing from the attorney and hope to have any changes made for voting at the annual meeting in Feb 2011. Linda asked the attorney to bill us quarterly from now on so the bill does not get so large. A motion was made by Erin to go into closed session and seconded by Dave and all others were in agreement. After discussion of covenant violations a motion was made by Erin to come out of closed session and seconded by Jim and all others agreed. A motion was then made by Erin to take legal action against the homeowner with the dog run and non- payment of dues for 6 years. This was seconded by Debbie and all others agreed. A motion was made to adjourn the meeting at 7:40pm by Erin and seconded by Dave and all others agreed.
