RIVERBEND WEST COMMUNITY HOMEOWNERS ASSOCIATION BOARD MEETING SEP 7, 2010 6:30 PM LIMESTONE LIBRARY BOARD MEMBERS PRESENT: LINDA FABER, ERIN WALKER, DEBBIE TURNER, DAVE RIVARD, JIM GALL 3 HOMEOWNERS PRESENT
Called to order by Linda at 6:30 pm. Public comment by Jim Bruno asking for a copy of the covenants because he believes a neighbor has a steel shed that is not in compliance. Linda told him that since the shed has been there since before the board was active and the current owners bought it, we felt that there was nothing we could do as told to us previously by the county. He asked that we check with our attorney which we will do and Erin will also call the county to see if anything has changed on our rights to enforce this. He also asked about the potholes by Devine’s corner. Linda did call the road commissioner and was told it would be fixed three weeks ago. Debbie will send a letter to him and the township board. Debbie will get Jim a copy of the current covenants. The secretary’s report was read by Debbie, motion to approve by Erin and seconded by Dave- all others were in agreement. Treasurer’s report was read by Dave, motion to approve by Erin, seconded by Debbie- all others were in agreement. There is only one homeowner who has not paid their dues now. Dave asked to be paid for postage for $8.00. Debbie made the motion, Erin seconded and all others agreed. OLD BUSINESS: Debbie will email all minutes to Christy to put on the website as well as the covenants. Linda talked to Denaults about putting lights on the sign by their house and they were happy to have them. Debbie volunteered to purchase these for $60. A motion was made by Debbie and seconded by Dave and all others agreed. Debbie will call Scenic landscaping to see if they are done with the landscaping on the corner lot and also to see if they are being paid for the lots they mow for homeowners who have not built yet. (2) The insurance bill questions from last month did not need a call around vote because one bill was for the property liability and the other was for the board members liability which had already been approved to pay as these are billed in two parts. The new board will get quotes next year to seek a better price. The “NO CONSTRUCTION TRAFFIC” sign by 113 is down again- Donnie Turner will check this again as it was up when he last checked. Chris was not here to tell us if the park had more mulch added so Debbie will check on this. NEW BUSINESS: Weenie Roast will be Sunday Oct 3 at 5pm since Saturdays are so busy. We want more people to be able to come. Linda will get s’mores and condiments, Debbie wood and Erin hot dogs, buns and plates. Debbie will do the flier. The covenants committee met at Steve Goytias. Present was Debbie Turner, Steve Schultz, Rita Sproul, Dave Baron, and Steve Goytia. They compared 3 different subdivisions covenants and prepared a list of possible clarifications to give to the attorney to review. Again these were only some minor wording changes. They will meet again after hearing from the attorney and hope to have any changes made for voting at the annual meeting in Feb 2011. Linda asked the attorney to bill us quarterly from now on so the bill does not get so large. A motion was made by Erin to go into closed session and seconded by Dave and all others were in agreement. After discussion of covenant violations a motion was made by Erin to come out of closed session and seconded by Jim and all others agreed. A motion was then made by Erin to take legal action against the homeowner with the dog run and non- payment of dues for 6 years. This was seconded by Debbie and all others agreed. A motion was made to adjourn the meeting at 7:40pm by Erin and seconded by Dave and all others agreed.

Covenant issues: Political signs in yards- by law people are allowed to have small political signs in yard before elections. Pool dispute- uphold covenant NO ABOVE GROUND SWIMMING POOLS which includes “kiddie pools” as it is too hard to make different rules for size or how long they are left up.
Election of board members John Jones and Christy Strole terms are not up until 2010. Debbie Turner was nominated by Steve Devine and seconded by Steve Goytia for the one vacancy on the baord. All present voted yes for Debbie to be on the board. There was no opposition for the other board members so they were re-elected by proclamation.
The meetings will continue to be at the library the first Tues of the month at 6:30pm.
Since only 4 homeowners in attendance it was talked about how to get more people interested in taking part in the association. It was brought up by Chris Benoit to offer an incentive in the form of a drawing at the annual meeting of those in attendance to win free homeowner dues for 2 years. This was voted on and all were in agreement. To be eligible you must be current on dues payment and board members are not eligible.
The meeting was adjourned at 11:00 am with a motion by John Jones and second by Steve Devine. The board went in to closed session.

Linda called the meeting to order at 6:35 pm. Debbie read the secretaries report. Dave made a motion to accept, Steve seconded and all others were in agreement. Dave read the treasurers report. Erin made a motion to accept and Debbie seconded and all others were in agreement. Old business- the garages sales went well despite the weather. Debbie will send Janet Jones a thank you for placing the ad in the journal under her account. Steve will call the 2 owners who are not mowing their vacant lots and Debbie will follow up with letters. Steve talked to the attorney about the covenants being revised. She advised to form a committee to review and bring her the proposed revisions to check legality before they are brought to the association for a vote. We will compare them to other association’s covenants. No one has volunteers to be on the committee after the letter went out asking for volunteers. Erin made a motion to pay John Jones $70 for the lights not $35 since there are 2 in the box and Donnie Turner will install them. Dave seconded and all were in agreement. Erin also made a motion for Debbie to send letters to the 2 homeowners on Stone Ridge Dr with trailers in the driveway. Steve seconded and all others were in agreement. Linda asked that a second copy of the minutes be kept for future requests from homeowners for back records. Debbie made the motion and Dave seconded, all others were in agreement. Debbie will make the copies. We plan to have the minutes on the website in the future for all to view. Debbie will also give Linda the state fees for bulk copying. Erin made a motion to implement these fees and Debbie seconded. All others were in agreement. Linda will call the homeowner about the request for 5 years of records with the fee that must be paid before they are given. New Business: The tree house that was on the easement in the new section behind Erin was burned down on Monday so nothing will need to be addressed. Linda will talk to the attorney about what can legally be done about the dog run that has been in the back of the subdivision for many years. A homeowner was present to address the board about this and some other issues, a trailer and a pool of stagnant water. The homeowner will call the county about the pool as it is a health issue. We will wait to hear from the attorney on the other issue and then deal with the trailer and pile behind the shed. Linda will check with Larry Hinton about the voting record when the subdivision association was started at a homeowners request to view. Steve made a motion to pay Debbie $14.80 for copying costs, Erin seconded and all others were in agreement. This was for the copies of the covenants for the new board members and the memo that went out to all homeowners. The meeting was adjourned at 7:20 pm.

The meeting was called to order at 6:35 pm by Linda. One homeowner was present. Debbie read the secretarie’s report. A motion was made by Erin to approve and seconded by Dave and all others were in agreement. Dave read the treasurer’s report and Debbie made a motion to approve, Erin seconded and all others approved. The mowing company complained about grass being dumped in the empty lot on Fox Run making it difficult to mow. A letter will be sent out asking that no grass be dumped on any vacant lots as they are actually private property. They are mowing these 2 lots on Fox Run and billing the homeowners per their request. The park has gotten quite long but has since been mowed. We will keep an eye on this.
Old Business: The attorney called to let us know that the lot with the landscaping issue will be done by the homeowner. They have hired Scenic Landscaping to do the work. All pending court action will be put on hold until next month. The complaint about the dog run and trailer and nonpayment of dues will be turned over to the attorney. Linda called the homeowner multiple times to tell them the fee for the copied minutes and reports they requested. They never returned any calls. A motion was made by Debbie to proceed with the attorney on this and seconded by Dave. There were 5 yes votes, one absent and one abstained. There is still a trailer on Stone Ridge Dr. A motion was made by Erin to send a final letter stating that this would be turned over to the attorney in 10 days if not moved and this was seconded by Chris. All others were in agreement. Dave will call since we have not received a final bill for the painting of the signs. Steve told Debbie he will have a meeting in August to go over the covenants and compare them to other associations. He will get a committee together.
New business: There were some complaints about pools in the new addition. This is not under our jurisdiction but Linda called Azzarelli to inquire what their ruling is on this for future reference. She was directed to Larry Hinton who said if it is not a permanent structure it is ok. The fall bonfire is tentatively set for Saturday October 2 at the park. Linda will call the attorney to check on our bill with her as we have never received one. Donnie will talk to Tom Martin about the drainage problem behind his house. If possible, he will get a skid steer from Tobey’s and knock it down. At the same time, he could do the river property and the pile on the empty lot on Fox Run to make it mowable. Late fee letter number 4 went to the 3 delinquent homeowners for dues. Linda will call the 2 families who have paid late in the past to see if there is a problem. Debbie was paid $20 for copying the minutes for the homeowner who requested them. There were over 200 pages.

The meeting was called to order with a motion by Linda Faber and seconded by Dave Butz. A log was made for the board members to be able to contact each other by phone or email. The previous secretaries reports will be given to Linda but there were no notes available so a motion was made by Christy Strole to hold the secretaries report until next month and it was seconded by Tom Martin. All other members approved. Christy read the Treasurers report and she motioned to accept the report and it was seconded by Dave Butz. All others approved. It was brought up by Linda to possibly hire an outside manager to do a lot of the tasks that the treasurer is now doing, i.e. getting in touch with homeowners who are in violation and following up on it. This will be brought up at a later date.
Kathy Call presented a picture of the shed she would like to put up on her property on River Bend Dr. It is an all plastic building to be purchased from Menards and then put together on a cement pad. As per the covenants, any building put on your lot must be architecturally compatible with your house. A vote will be taken in closed session after further discussion of the board.
Other homeowners have complained that the rocks on three corners in the subdivision are a hazard to cars and children. It is not the job of the board to remove these as they are actually in violation of county code that there can be no obstruction 30 feet from the road and it is up to Glenn Kramer to take care of this. A letter will go out stating that he could remove these at any time if he deems necessary but is has nothing to do with the homeowners association.
It will also again be put in the newsletter that there is to be no grass or clipping dumping on empty lots or at the river. Dave states it is very hard on his mower when there is debris on the lots. Dave Butz and others put in a lot of time to clean up the river site and we want to keep it that way. We will look into putting up chains as a gate at the end of the summer if the problem continues. We will also put in the newsletter that if anyone sees some one dumping to please call the sheriff.
NEW BUSINESS:
The lot in the new addition with all the construction equipment is an eyesore. We will call Larry Hinton at 937-8700 and ask that the lot be cleaned up as it is a reflection on all of River Bend.

The next meeting will be on Aug 4 at Linda Faber’s house with dinner for the board to follow. The business meeting will be at 6pm. The board went in to closed session to discuss other issues.

Mr Schneider was back to request that the association pay ½ of a $13,000 bill to put drainage tile in his field to avert the flooding from run off from the subdivision. Again he was told we do not feel this is our responsibility. Azzarelli developed the subdivision and the county approved it He threatened a law suit but again he was told to follow up with the county as they are responsible He stated that Mr Girard changed the flow of water at the back of his lot, a lot of people have their down spouts going into the ditches, a lot of people use sprinklers and sump pumps and this is all causing the flooding of his farm ground according to him We will get in touch with Glenn Kramer about cleaning out the ditch at the back of the subdivision as Mr Schneider thinks this will help

Old Business was started when a call was received that there were people at the library for the meeting Linda told them it was on the website that the meeting was changed to her house this month for our annual cookout for the board The homeowners were welcome to come over which they did They were upset and aired their grievances and since we were already in closed session we let them speak and will talk about it at the next meeting.

RIVERBEND WEST COMMUNITY ASSOCIATION BOARD MEETING SEP 1, 2009

Linda called the meeting to order and welcomed the approximately 30 homeowners present. The board introduced themselves. Linda read the attached letter in response to the questions that have arisen over the last few months. Four members have requested to speak tonight. Rita Sproul started by thanking the board for their work. Her main concern is that it is taking years to try to fix the same problem- pools. She feels everyone should have to follow the covenants and it is not fair to the other homeowners when a few people chose not to. Donald Anderson then spoke and made a motion to dismiss the four board members that were elected in April. He stated that because the meeting was not held prior to March 1, there were only two board members in April and therefore there was not a quorum to elect other members. Jeff Duffield and Chris Walker supported the motion. Mr Anderson was informed that the board would have to receive written notification 10 days prior to a special meeting called for this purpose. Steve Schultz then had a turn and again thanked the board for their work in trying to enforce the covenants. Rich Berns was the last to speak. He also thanked the board and stated they are improving on what the members of the first board of which he was a member started many years ago. He thought we should plant trees along the river property on Rt 113 and put up a gate with a combination lock that homeowners in good standing would have access to the code. He asked who sent out the attached letter that was put in some of the homeowners doors and was signed ‘The Fox’. He asked Mr Anderson if he did this and he admitted it. Mr Berns than stated how upset he was that Mr Anderson has had an inflatable pool in his yard for at least two summers and he himself is doing the right thing and installing an in ground pool at a large cost to comply with the covenants. He stated that all homeowners knew the rules when they moved in and should abide by them.
Debbie Turner read the secretary’s report and a motion was made to approve by Tom Martin and seconded by John Jones and all others were in favor.
Christy Strole read the treasurers report. Dave Butz made a motion to approve and John Jones seconded and all others approved.
OLD BUSINESS
It was announced that meetings will be at the library on the first Tues of every month at 6:30. We were informed tonight that an application must be turned in for this. If for some reason the meeting is cancelled, a notice will be posted on the library door and on the website. The annual meeting will also now be held at the library in Feb. We received the attached letters from Don Anderson’s attorney. The minutes and financial records will be forwarded though it is noted that prior to this board’s tenure, there may not be adequate records of meeting.
NEW BUSINESS
The minutes are available to homeowners by request and there will be a copying fee for this. Mr Windmiller was concerned about golf carts and scooters, brick mailboxes and liability to the association. Debbie Turner will get the rules and laws for motorized vehicles.
Oct 24 will be the Weiner Roast at the park. The board members will supply the hotdogs and s’mores and everyone will be asked to bring a dish to pass. We will see if we can get a hay ride. Rita Sproul volunteered to buy the food when she gets the food for the concession stand. Thank you to her.
We took an informal vote to see how people would like to be notified of news and events in the neighborhood- mail, flyer or website. It was decided on flyers. Rita Sproul volunteered to pass them out on Sunset View and Pam Gall will do Ridge View. We will seek other volunteers for Riverbend Dr, Stone Ridge Dr and the two other streets. Steve Schultz asked if it was possible to put lights on the two other Riverbend signs. Ron Fiets asked that a dead tree behind his house on association property be removed. Dave Butz will see if this is something he can do.
Steve Goytia asked why the new addition is not part of our association and covenants. Linda stated that it is in the county plan that after a certain number of lots are sold they will have the option to join our association, form a new association or have no association. The are not to that point yet.
The terms of John Jones, Christy Strole and Tom Martin will be up in 2010 for anyone interested in being on the board.
Linda asked for a motion to be made to go into closed session. This was done by Christy and seconded by Dave Rivard. The homeowners were again thanked for coming.

He was then read Article V Section 2 of the bylaws which clearly states this. He was confusing this with Article 3 Section 6 which covers quorums but not election of the board. He left angry again. The meeting continued with reading of the secretaries report. A motion was made to approve by John and seconded by Christy and all others were in agreement. The treasurers report was read and Debbie made a motion to approve and seconded by John. All others approved.

The bonfire will be Oct 24 at 6pm at the park. Linda will provide buns and s’mores. John will provide mustard and relish, Christy catsup, Debbie wood and hotdogs. John will call to get more tables from the park district. Debbie will type a flyer.
Christy will prepare a preliminary budget for 2010.
John will call to get an estimate to remove the tree behind Fiets home. Dave and John will also talk with Ron Fiets about where the property stakes are to be sure it is the associations and not Mr Schneiders tree. They will also let Ron know the equipment will have to go through his yard.
We will talk at the annual meeting about the river lot and possibly planting wild flowers, trees. landscaping and a gate.
New Business:
Dave Butz sold his house and will resign from the board next month. Debbie will put a note on the flyer to see a board member if anyone would like to be on the board.
John will let the park district know there is a broken table at the park.
Dave also let us know that he had to have his house checked for Radon and it was very high. He had to have this removed before closing. It will cost about $1000.
Zavala landscaping was dumping at the river lot- the situation has been taken care of. They thought it was ok to put rock there.

Linda and Dave met with the attorney and dismissed the case against Jim Bruno since the truck is gone. She advised us to wait until Spring to address the pool and call her as soon as it goes up and she will immediately take action with a letter so the pool will not be up all summer. We were also advised to mail the flyers for the annual meeting. If we receive a registered letter back refused, she said to remail it in a plain envelope. The attorney sent a letter to Langlois that stated they had until Sep 28 to finish the work on their yard which is still not done. She will now send a letter to go to court stating that they need 3 trees and finish the wall or fill the crack on the side of the house. We will have the work done and then bill them when we get the court order. Christy made a motion to close the meeting at 7:40 pm and it was seconded by Dave and all were in agreement.

The meeting was called to order by Linda. Debbie Turner read the secretary report. John made a motion to approve and Christy seconded. All others approved. Christy Strole read the treasurers report. She made a preliminary budget based on the income and expenses from the previous years. It was agreed that before a final budget is done, estimates will be needed for the sign repair, tree removal and landscaping for a homeowner not in compliance with the covenants. Annual fees may have to be increased depending on the outstanding estimates. Dave made a motion to accept the report and Debbie seconded it. All others were in agreement.
Old Business: The bonfire will be earlier next year to try to draw a bigger crowd. It was talked about what to do about the current and past covenant violations. There will be a lien placed on any property to cover court expenses or expenses to bring a homeowner to compliance. Since all pools are down for the year, this issue will be taken care of immediately in the Spring if the pools are put up as the attorney has already done all the preliminary work. John will get the estimate for tree removal off Fiets’ property. We may ask them to split the cost depending on the bid and the need to set a precedent. Again it was noted that we have to be sure that the tree is on Association property and not private property.
New Business: Dave Butz resigned since he has sold his home. It was on the flyer that went out last month to call a board member to give a name of anyone interested in being on the board. There was no response. Christy made a motion to accept his resignation and it was seconded by Debbie. A list was compiled of people who may be interested in serving on the board. Linda will contact these people to see if they are interested. The term would expire at the annual meeting in February. (Erin Walker, Denise Elliott, Rita Sproul, Brian Vaughn, Paula Uphoff)
The road at the 113 entrance was fixed and a drainage ditch was made with concrete to alleviate the ice problem we have had in the past. We will thank Glenn Kramer for doing this.
Bids will be obtained to fix the signs at the entrances. There may need to be a special assessment to cover the cost. This will hopefully be ready for the annual meeting.
There are a few new compliance issues with trailers and exterior lights and letters will be sent out. Steve Devine will fix the rotten boards on the entrance sign.
Temporary signs will be posted at the entrances on meeting days (bonfire etc) to remind homeowners. The flyers for the bonfire were put in journal boxes by Debbie and some people again stated they did not receive them.
Steve Devine thought it would be nice to have a Christmas party for the kids or maybe an Easter egg hunt. It was agreed this was a great idea and we will try for Easter.
Lemenager Insurance has asked to review our policy and perhaps give us a bid for next year. This was agreed to be done.
Christy made a motion to close the meeting at 7:40pm and this was seconded by John and all others were in agreement.

River Bend West Homeowners Association Board Meeting
Jan 5, 2010 Limestone Library 6:30 pm
Linda Faber called the meeting to order. Board members present were Linda Faber, David Rivard, Christy Strole, Debbie Turner, John Jones and Tom Martin. There were 2 homeowners present.
Public comment: Paul Roeder brought a picture of his Christmas decorations that some kids messed with. He was not upset but just wanted the board to be aware.
Secretary’s report was read by Debbie Turner. Christy Strole made a motion to accept it and it was seconded by John Jones. All others agreed.
Treasurer’s report was read by Christy Strole. Tom Martin made a motion to accept it and John Jones seconded it. All others were in agreement.
Old Business: Dana Meyer, the attorney, has not started the paperwork yet for the claim on the property not in compliance. There was a vacancy in the court. She will now do that. It will take about two months to go through. Zavala gave a bid of about $1200 for the work and $300 per summer to spray Round up. We will do this for 5 years. Court costs and interest will also be added with the above amount to the lien on their property. A motion was made by Debbie to proceed with this and Tom seconded.
Friendly Signs gave a bid of $800 per sign to sandblast and paint the 4 signs. Tom suggested we get 2 more bids. Linda will call Creative Edge and Ginter in Manteno. We will have this at the next meeting and then present it to the homeowners in February.
Dave will call Girard Electric to replace the light on the sign by the river.
No one talked to Bossert but he is not on the board now so Christy will call Rich Berns about the rocks on the corners. We have already spoken to Kramer and sent a letter asking that they be removed.
Christy will work on a preliminary budget for the next meeting to then present at the annual meeting.
John has a bid for the tree removal at the back of Fiets property of $575 from Four Seasons. We again feel since we do not know for sure whose property this is on, we can not just remove the tree. Tom will talk to Dave Butz since he originally looked into this and he will then talk to Ron Fiets. The board feels we can not set precedence and remove the tree when it is not causing a problem, would not damage anything if it did fall and could be on Schneider’s property or the easement. If Ron can find the stakes and prove it is on Association property, the matter will be re evaluated.
New Business: We need a nominating committee to elect 3 new board members. Debbie will call some members of the Covenance committee and ask them to find 3 homeowners who would serve on the board. They will give her the list for Feb to have ready for the annual meeting. She will also call Rita to see if she will stay on board since she was just filling in for Dave Butz. (Rita did agree so we need 3 more to fill for John, Tom and Christy)
The board will stay after the annual meeting to have the election of the new board.
Tom Martin made a motion to raise the dues to $100 annually. This will be brought up for a vote at the annual meeting. This would allow us to enforce the covenants easier and make needed improvements in the neighborhood. The dues have never been raised. Debbie seconded the motion and all others were in agreement.
We will all bring ideas to the next meeting for anything we feel needs to be added to the agenda for the annual meeting.
Tom also suggested that newly elected board members would be exempt from paying dues while they are on the board. (Rita would be eligible since she has not been elected yet) We thought this might help get new board members. Christy made a motion to accept this, Debbie seconded it and all others were in agreement.
Letters will go out to Richey’s, Benoit’s, Langlois’, and Billingsley’s about the trailers in their driveways.
Debbie will have the flyers ready for the next meeting. They will announce the date and time, voting on raising the dues and nominating new board members. There will also be a note to check the website for the agenda and further info. Christy did not have a program for labels. Debbie will make the signs for the three entrances to remind everyone about the meetings.
Linda asked for a motion to close the meeting at 7:35 pm. Debbie made the motion and Christy seconded it.
